9. Intellectual Property

The Platform and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, educational guides, articles, and the design, selection, and arrangement thereof) are owned by EarnifyHub, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

9.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use, subject to these Terms.

9.2 Restrictions

You may not:

• Reproduce, distribute, modify, or create derivative works of our content
• Republish, download (except for caching), store, or transmit any material without our prior written consent
• Remove or alter any copyright, trademark, or proprietary notices
• Use our content for commercial purposes without a license

10. User Content

• Terminate accounts that violate these Terms

11. Third-Party Links & Platforms

11.1 No Control Over Third Parties

The Platform contains links to and information about third-party earning platforms, websites, and resources. You acknowledge and agree that:

• EarnifyHub does not operate, control, or endorse these third-party platforms
• We are not responsible for the availability, accuracy, content, products, services, or practices of third-party platforms
• We do not guarantee the legitimacy, solvency, or continued operation of any third-party platform
• Links to third-party platforms do not constitute endorsement or recommendation

11.2 Your Responsibility

EarnifyHub does NOT:

• Process, facilitate, or guarantee payments from third-party platforms
• Have access to your accounts on third-party platforms
• Control payment timelines, methods, or amounts
• Resolve disputes between you and third-party platforms

Payment issues must be resolved directly with the third-party platform. We may provide general guidance but cannot intervene in payment disputes.

11.4 Platform Changes

Third-party platforms may change their terms, requirements, bonuses, or operations at any time. Information on EarnifyHub may become outdated. Always verify current terms directly with the platform before engaging.

12. Sponsored Content & Affiliate Disclosure

12.1 Sponsored Placements

Some platforms listed on EarnifyHub pay for sponsored placement or featured positioning. These placements:

• Are clearly marked as "Sponsored," "Paid," or "Featured"
• May receive paid promotional traffic in addition to organic traffic
• Are still subject to our vetting standards (we reject scams regardless of payment)
• Do not constitute endorsement or recommendation

12.2 Affiliate Relationships

EarnifyHub may earn commissions from some platforms when users sign up or make transactions through our links. These affiliate relationships:

• Are disclosed when material to the content
• Do not affect our vetting standards
• Do not influence our educational content (reviews remain objective)
• Are governed by FTC guidelines for affiliate marketing

12.3 No Guarantee Clause

Whether sponsored, affiliated, or organically listed, EarnifyHub makes NO guarantees about:

• Platform performance, earnings, or results
• Your eligibility or acceptance by platforms
• Bonus payouts or promotional offers
• Long-term platform stability

12.4 FTC Compliance

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NEITHER EARNIFYHUB NOR ANY PERSON ASSOCIATED WITH EARNIFYHUB MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO:

• The completeness, accuracy, reliability, quality, or currency of the Platform or its content
• The availability, security, or uninterrupted operation of the Platform
• That defects will be corrected or errors fixed
• That the Platform or server are free of viruses or harmful components
• That the Platform will meet your needs, expectations, or requirements

SPECIFICALLY, EARNIFYHUB DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR:

• Any specific earnings, income, or financial results from using the Platform
• Any earnings, bonuses, or payments from third-party platforms
• The legitimacy, solvency, or continued operation of any third-party platform
• The accuracy or currency of information about third-party platforms
• Your eligibility for or success with any earning opportunity
• The payment practices, timelines, or reliability of third-party platforms

YOUR USE OF THE PLATFORM, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE PLATFORM IS AT YOUR OWN RISK. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, LOSS OF DATA, OR OTHER HARM THAT RESULTS FROM YOUR USE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF WARRANTIES OR LIMITATIONS ON THE DURATION OF IMPLIED WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU IN ITS ENTIRETY, BUT WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL EARNIFYHUB, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS (COLLECTIVELY, "EARNIFYHUB PARTIES") BE LIABLE FOR:

14.1 Types of Damages Excluded

• ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, REVENUE, BUSINESS, OR ANTICIPATED SAVINGS
• ANY LOSS OF OR DAMAGE TO DATA, GOODWILL, OR REPUTATION
• ANY PERSONAL INJURY OR PROPERTY DAMAGE
• ANY FAILURE TO EARN INCOME OR FINANCIAL LOSSES FROM THIRD-PARTY PLATFORMS
• ANY LOSSES ARISING FROM YOUR RELIANCE ON INFORMATION PROVIDED ON THE PLATFORM
• ANY LOSSES ARISING FROM THIRD-PARTY CONDUCT OR CONTENT

14.2 Legal Theories Covered

This limitation applies UNDER ANY LEGAL THEORY, whether based on:

• Warranty, contract, tort (including negligence), strict liability, or any other legal theory
• Whether or not we have been informed of the possibility of such damage
• Even if a remedy set forth herein is found to have failed of its essential purpose

14.3 Maximum Liability Cap

IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS, EARNIFYHUB PARTIES ARE FOUND LIABLE FOR ANY LOSS OR DAMAGE, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF:

• $100 (ONE HUNDRED US DOLLARS), OR
• The amount you paid to EarnifyHub (if any) in the 12 months preceding the claim

THE FOREGOING LIMITATIONS WILL APPLY EVEN IF AN EXCLUSIVE REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY.

15. Indemnification

You agree to defend, indemnify, and hold harmless EarnifyHub Parties from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising out of or relating to:

• Your violation of these Terms or any applicable law or regulation
• Your use or misuse of the Platform
• Your User Content or any content you post
• Your violation of any rights of another person or entity
• Your interactions with third-party platforms
• Any financial losses you incur from using third-party platforms
• Any disputes between you and third-party platforms
• Your unauthorized use of the Platform's content, services, or products
• Any information obtained from the Platform

This indemnification obligation will survive the termination of these Terms and your use of the Platform.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defenses.

16. Termination

16.1 Termination by EarnifyHub

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Violation of intellectual property rights
• Spam, harassment, or other prohibited conduct
• Any reason or no reason at all

16.2 Termination by You

You may terminate your account at any time by:

• Discontinuing use of the Platform
• Deleting your account through account settings (if applicable)
• Contacting us to request account deletion

16.3 Effect of Termination

Upon termination:

• Your right to access and use the Platform will immediately cease
• We may delete your account and any content associated with it
• Advertiser listings may be removed without refund
• All provisions of these Terms that by their nature should survive will survive (including disclaimers, limitations of liability, indemnification, and intellectual property provisions)

17. Governing Law & Dispute Resolution

17.1 Governing Law

These Terms and any disputes arising out of or related to them or the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

17.2 Jurisdiction and Venue

You agree that any legal action or proceeding between you and EarnifyHub shall be brought exclusively in the federal or state courts located in Delaware, and you irrevocably submit to the personal jurisdiction of such courts.

17.3 Dispute Resolution

Before filing any legal action, you agree to first contact us at our contact page to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably.

17.4 Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect and enforceable to the fullest extent permitted by law.

17.5 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Platform, constitute the entire agreement between you and EarnifyHub regarding your use of the Platform.

18. Changes to Terms

18.1 Right to Modify

We reserve the right, at our sole discretion, to modify, update, or replace these Terms at any time. Changes may be necessary due to:

• Legal or regulatory requirements
• Changes to our services or business practices
• Security or technical considerations
• Clarification or improvement of terms

• You will not hold EarnifyHub responsible for third-party platform conduct
• You accept all risks associated with using third-party earning platforms
• No earnings, income, or financial results are guaranteed
• You are responsible for your own due diligence and financial decisions
